1. Purpose and Scope

This Abuse and Enforcement Policy ("Policy") establishes Vexion’s authority, procedures, and rights for detecting, investigating, preventing, and enforcing violations of its agreements, including but not limited to the Terms of Service, Acceptable Use Policy, Billing and Subscription Agreement, and other applicable agreements (collectively, the "Agreements").

This Policy forms part of the contractual agreement between you ("Customer", "User", "you", or "your") and Vexion.

2. Definition of Abuse

Abuse includes any activity that:

  • Violates any Agreement;
  • Violates applicable laws;
  • Threatens infrastructure integrity;
  • Disrupts service availability;
  • Creates legal, financial, or operational risk for Vexion;
  • Harms other customers or third parties.

Vexion retains sole discretion in determining whether conduct constitutes abuse.

3. Detection of Abuse

Abuse may be detected through:

  • Automated monitoring systems;
  • Infrastructure performance monitoring;
  • Security systems;
  • Internal investigations;
  • Reports from third parties;
  • Reports from law enforcement;
  • Customer reports.

Vexion reserves the right to deploy automated systems to detect abuse.

4. Investigation Authority

Vexion reserves the right to investigate suspected abuse without notice.

Investigation actions may include:

  • Reviewing infrastructure logs;
  • Analyzing traffic patterns;
  • Reviewing account activity;
  • Inspecting system behavior;
  • Cooperating with law enforcement;
  • Collecting forensic evidence.

You consent to such investigations.

5. Immediate Enforcement Authority

Vexion may immediately enforce protective measures without notice where reasonably necessary to protect infrastructure or comply with legal obligations.

Protective measures may include:

  • Immediate suspension of Services;
  • Immediate termination of Services;
  • Infrastructure isolation;
  • Blocking network traffic;
  • Restricting access;
  • Disabling accounts.

Enforcement actions may occur automatically.

6. Suspension of Services

Vexion may suspend Services where abuse is suspected or confirmed.

Suspension may occur:

  • Without notice;
  • Without prior investigation;
  • Automatically;
  • Indefinitely.

Suspension does not entitle you to refunds.

7. Termination of Services

Vexion may terminate Services where abuse is confirmed or reasonably suspected.

Termination may occur without notice.

Termination may result in permanent loss of data.

You are responsible for maintaining backups.

8. Infrastructure Protection Priority

Protection of infrastructure, systems, and other customers takes priority over continued service availability.

Vexion may take any action necessary to protect infrastructure integrity.

9. Cooperation with Law Enforcement

Vexion may cooperate with law enforcement and regulatory authorities.

This may include:

  • Disclosure of account information;
  • Disclosure of infrastructure logs;
  • Compliance with legal orders;
  • Participation in investigations.

10. Customer Cooperation

You agree to cooperate with abuse investigations.

Failure to cooperate may result in suspension or termination.

11. Cost Recovery

You agree to reimburse Vexion for all costs arising from abuse, including:

  • Investigation costs;
  • Incident response costs;
  • Infrastructure repair costs;
  • Legal costs;
  • Administrative costs.

12. Fraud Prevention

Vexion may suspend or terminate Services where fraud is suspected.

This includes suspected payment fraud or identity fraud.

13. No Liability for Enforcement

To the maximum extent permitted by law, Vexion is not liable for damages arising from enforcement actions taken in good faith.

14. No Obligation to Provide Prior Notice

Vexion has no obligation to provide prior notice of enforcement actions.

15. Appeals

Vexion may, at its sole discretion, review enforcement actions upon written request.

Vexion is not obligated to reverse enforcement actions.

16. Reporting Abuse

Abuse may be reported to:

abuse@vexion.io

17. Amendments

Vexion may modify this Policy at any time.

Changes become effective upon publication.

Continued use of Services constitutes acceptance.

18. Survival

This Policy survives termination of Services.

19. Governing Law

This Policy is governed by the laws of Queensland, Australia.

You submit to the exclusive jurisdiction of Queensland courts.
